What are the changes?
1. Chapter 1 Article 1 paragraph 8 Regarding: The position of the halal fatwa commission at the MUI Province, district/city and Aceh Ulema Council which was previously not included in PP 39 of 2021
2. Article 5 Article 51: Validity period of halal certificates
The latest regulation emphasizes that halal certificates remain valid, as long as there are no changes. If there are changes in the composition and ingredients, they must be reported to BPJPH
The regulations for business actors who have obtained halal certificates are required to:
a. Include a halal label on the product
b. Maintain the halalness of the product
c. Separate the processing and serving areas between halal and non-halal products
d. Update the halal certificate if there is a change in the composition of the ingredients
e. Report changes in material composition to BPJPH
3. Chapter 5 Article 52: Inspection of product halal consistency
To maintain product halalness, BPJPH implements product halal checks (surveillance) every 4 years to ensure consistent product halalness. In financing surveillance, the Government provides relief for MSME business actors which is borne by the government
4. Chapter 5 Article 66: Provisions for halal supervisors for MSMEs
Halal supervisors for MSMEs can come from Islamic religious community organizations or can come from the relevant business actors, government agencies.
The Government also provides relief for MSMEs that register for self-declare certification in the form of exemptions from halal certified halal supervisors.
5. Chapter 6 Article 99: Obligations for halal certification and sanctions applied
- PPH assistance is carried out by PPH assistance institutions
- PPH assistance institutions come from Islamic community organizations, Islamic religious institutions and universities
- PPH assistance institutions are determined by the head of the agency
- PPH assistance institutions have the obligation to recruit PPH assistance, appoint and dismiss PPH assistance, provide guidance and evaluation of PPH assistance performance, submit PPH assistance performance reports to BPJPH
6. Chapter 7 Article 109: Rules for including halal labels on packaging
The new regulation emphasizes the provisions for including labels for products that are not sold to consumers, it is not mandatory to include labels on product packaging.
7. Chapter 10 Article 148: Copy of halal certificate for products from abroad Registration of foreign halal certificates is submitted by each importer domiciled in the territory of Indonesia to BPJPH in writing. Changes to PP no. 42 of 2024 emphasize that copies of halal certificates do not need to be legalized by Indonesian representatives abroad.
8. Chapter 11 Article 160: Extension of the period for halal certification obligations
The first stage of halal certification, which states the obligation for halal certification until October 17, 2024, was then postponed until no later than October 17, 2026.
